Chess Opening Tactics

Welcome to Chess Opening Tactics! By downloading, installing, or using our mobile application ("App"), you agree to be bound by these Terms of Use ("Terms"). Please read them carefully before using the App.

1. Acceptance of Terms

By accessing or using Chess Opening Tactics, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, do not use the App.

2. License to Use

Dawikk ("we," "us," or "Service Provider") grants you a limited, non-exclusive, non-transferable, revocable license to use Chess Opening Tactics for personal, non-commercial purposes, subject to these Terms.

You may NOT:

Modify, reverse engineer, decompile, or disassemble the App
Remove any copyright or proprietary notices from the App
Use the App for any unlawful purpose
Attempt to gain unauthorized access to any portion of the App
Reproduce, distribute, or create derivative works from the App

♔ 3. Subscriptions & In-App Purchases ♕

3.1 Subscription Plans

Chess Opening Tactics offers auto-renewable subscription plans that provide access to premium features, including:

Ad-free experience
Unlimited access to all puzzles and features
Premium support
Access across all Dawikk chess apps

3.2 Subscription Pricing & Duration

Subscription plans are available for:

1 Month (Beginner Plan)
3 Months (Advanced Plan)
6 Months (Grandmaster Plan) - Recommended

Prices are displayed in the App and may vary by region. All prices include applicable taxes.

3.3 Payment & Automatic Renewal

IMPORTANT: Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period.

Payment will be charged to your Apple ID account at confirmation of purchase
Subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current period
Your account will be charged for renewal within 24 hours prior to the end of the current period
You can manage your subscription and turn off auto-renewal in your Apple ID Account Settings after purchase

3.4 Cancellation

You may cancel your subscription at any time. To cancel:

Go to your iPhone Settings
Tap your name at the top
Tap "Subscriptions"
Select Chess Opening Tactics
Tap "Cancel Subscription"

Upon cancellation, you will continue to have access to premium features until the end of your current billing period. No refunds will be provided for the unused portion of any subscription period.

3.5 Free Trial

If a free trial is offered, you will be charged the full subscription price at the end of the trial period unless you cancel before the trial ends. Free trials are available once per user.

3.6 Refund Policy

All purchases are final. Refunds are handled by Apple and subject to Apple's refund policies. To request a refund, please contact Apple Support directly or visit support.apple.com.

4. User Conduct

You agree to use Chess Opening Tactics in accordance with these Terms and all applicable laws. You agree NOT to:

Use the App to harass, abuse, or harm others
Transmit any malicious code or viruses
Interfere with the proper functioning of the App
Collect or harvest any information from the App or our systems
Use the App for any commercial purposes without our written permission

5. Intellectual Property

All content, features, and functionality of Chess Opening Tactics, including but not limited to:

Chess puzzles and tactical positions
Text, graphics, logos, and images
Software code and algorithms
Design and user interface

are owned by Dawikk and are protected by international copyright, trademark, and other intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from any content in the App without our express written permission.

6. User Accounts & Data

To access certain features, you may need to create an account (e.g., Google Sign-In). You are responsible for:

Maintaining the confidentiality of your account credentials
All activities that occur under your account
Notifying us immediately of any unauthorized use of your account

We collect and process your data as described in our Privacy Policy.

7. Advertisements

The free version of Chess Opening Tactics may display advertisements. Premium subscribers enjoy an ad-free experience. We use third-party advertising services (Google AdMob) that may collect information as described in our Privacy Policy.

8. Disclaimers & Limitation of Liability

8.1 "AS IS" Basis

Chess Opening Tactics is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied, including but not limited to:

Warranties of merchantability or fitness for a particular purpose
Warranties that the App will be error-free or uninterrupted
Warranties regarding the accuracy or reliability of content

8.2 Limitation of Liability

To the maximum extent permitted by law, Dawikk shall not be liable for any:

Indirect, incidental, special, consequential, or punitive damages
Loss of profits, data, or goodwill
Service interruptions or errors
Damages resulting from unauthorized access to your account

Our total liability shall not exceed the amount you paid for the App in the 12 months preceding the claim.

9. Changes to Terms

We may modify these Terms at any time. We will notify you of significant changes by:

Posting the new Terms in the App
Updating the "Effective Date" at the top of this document
Sending an in-app notification or email (if applicable)

Your continued use of the App after changes become effective constitutes acceptance of the modified Terms.

10. Termination

We reserve the right to suspend or terminate your access to Chess Opening Tactics at any time, without notice, for:

Violation of these Terms
Fraudulent or illegal activity
Any reason we deem necessary to protect the App or other users

Upon termination, your license to use the App will immediately cease, and you must delete the App from your device.

11. Third-Party Services

Chess Opening Tactics uses third-party services, including:

Google Play Services - Privacy Policy
Google AdMob - Privacy Policy
Expo - Privacy Policy
Apple In-App Purchases - Terms

These services have their own terms and privacy policies. We are not responsible for the practices of third-party services.

12. Children's Privacy

Chess Opening Tactics is not intended for children under the age of 13. We do not knowingly collect personal information from children under 13. If you are a parent or guardian and believe your child has provided us with personal information, please contact us immediately.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Poland, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts in Poland.

14. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Dawikk regarding your use of Chess Opening Tactics.
