Terms of Use - Chess Mates 2-3-4

Acceptance of Terms

By downloading, installing, or using the Chess Mates 2-3-4 application ("App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the App.

Important: These Terms constitute a legally binding agreement between you and Dawikk ("Service Provider", "we", "us", or "our").

License Grant

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App for your personal, non-commercial use on devices you own or control.

License Restrictions

You agree NOT to:

Copy, modify, or create derivative works of the App
Reverse engineer, decompile, or disassemble the App
Remove, alter, or obscure any proprietary notices on the App
Use the App for any commercial purpose without our written consent
Distribute, sell, lease, rent, lend, or sublicense the App
Use the App in any way that violates applicable laws or regulations

Subscriptions and In-App Purchases

Auto-Renewable Subscriptions

The App offers auto-renewable subscription options with the following terms:

Subscription Details:

Title: Premium Chess Mates Subscription
Length: 1 month, 3 months, 6 months, or 1 year (as selected)
Price: Displayed in the App at the time of purchase
Payment: Charged to your App Store account at confirmation of purchase
Auto-Renewal: Subscription automatically renews unless canceled at least 24 hours before the end of the current period
Renewal Charge: Account will be charged for renewal within 24 hours prior to the end of the current period

Managing Subscriptions

You can manage your subscriptions and turn off auto-renewal by going to your App Store Account Settings after purchase. Cancellation takes effect at the end of the current subscription period.

One-Time Purchases

The App also offers one-time purchase options. These are permanent licenses that do not auto-renew and provide lifetime access to premium features.

No Refunds

All purchases are final. Refunds are handled according to the App Store's refund policy. We do not provide refunds directly.

Premium Features

Premium subscription includes:

Unlimited hints and puzzle solutions
Ad-free experience
Advanced analytics and statistics
Exclusive chess puzzles and training modes
Priority customer support
Access to all future premium features

Note: Premium features are subject to change. We reserve the right to modify, add, or remove features at our discretion.

User Conduct

You agree to use the App responsibly and in compliance with all applicable laws. You must not:

Use the App to harass, abuse, or harm others
Attempt to gain unauthorized access to the App or its related systems
Use automated scripts, bots, or cheating tools
Upload or transmit viruses or malicious code
Interfere with or disrupt the App's functionality
Impersonate any person or entity
Collect or harvest information about other users

Intellectual Property Rights

The App and all its contents, features, and functionality (including but not limited to information, software, text, displays, images, video, and audio) are owned by Dawikk or its licensors and are protected by copyright, trademark, and other intellectual property laws.

Chess Puzzles

All chess puzzles, training materials, and educational content in the App are proprietary to Dawikk or licensed from third parties. You may not reproduce, distribute, or create derivative works from this content.

Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

The App will meet your requirements or expectations
The App will be uninterrupted, timely, secure, or error-free
Any errors or defects will be corrected
The App is free of viruses or other harmful components

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL DAWIKK BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

Your use of or inability to use the App
Any unauthorized access to or use of our servers
Any interruption or cessation of transmission to or from the App
Any bugs, viruses, or other harmful code transmitted to or through the App
Any errors or omissions in any content or for any loss or damage incurred as a result of your use of any content

Indemnification

You agree to defend, indemnify, and hold harmless Dawikk and its licensors, employees, contractors, agents, officers, and directors from and against any claims, damages, obligations, losses, liabilities, costs, or debt, and expenses arising from:

Your use of and access to the App
Your violation of any term of these Terms
Your violation of any third-party right, including any copyright, property, or privacy right

Termination

We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason, including but not limited to breach of these Terms.

Upon termination:

Your right to use the App will cease immediately
You must delete all copies of the App from your devices
Any provisions that by their nature should survive termination shall survive

Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms in the App and updating the "Last Updated" date at the top of this document.

Your continued use of the App after any changes to these Terms constitutes your acceptance of the new Terms. If you do not agree to the revised Terms, you must stop using the App.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of Poland, without regard to its conflict of law provisions.

Privacy Policy

Your use of the App is also governed by our Privacy Policy. Please review our Privacy Policy to understand our practices.

Children's Privacy

The App is not intended for children under the age of 13. We do not knowingly collect personal information from children under 13. If you are a parent or guardian and believe your child has provided us with personal information, please contact us immediately.

Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Dawikk regarding the use of the App and supersede all prior agreements and understandings.

Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

Acknowledgment

By using the Chess Mates 2-3-4 app, you acknowledge that you have read, understood, and agree to be bound by these Terms of Use.
